DATA PROTECTION POLICY

  1. DATA CONTROLLER
    Your personal data shall be processed by FLUIDRA, S.A., domiciled at Avda Francesc Macià 60, pl. 20, 08208 Sabadell (Barcelona), and holder of TIN A17728593.
  2. PURPOSES AND LEGAL BASIS
    Your personal data shall be processed for the purpose of sending newsletters adapted to your interests.
    The legal basis for processing your data in both cases is the consent given by you to do so.
  3. DISCLOSURE OF DATA
    Your data shall not be assigned, sold, leased or otherwise made available to third parties, except in the case of FSA’ service providers who render certain services to FSA, who shall under no circumstance process them for their own purposes. Your personal data may also be disclosed to other FLUIDRA Group companies, which shall process them for the purposes stated, notwithstanding any additional information that each company may provide to you.
    Some of these service providers may be based outside of the European Union, as stated in the section “International Transfers”.
  4. AUTOMATED DECISIONS AND PROFILING
    FSA can create a profile through the analysis of your web behavior, showing you products that may be of your interest on the basis of the preferences you have shown through your browsing, or information obtained by means of cookies.
    Such personalization will be made in a partially automatized means, in the sense that FSA shall determine the personalization parameters although it is the technological platform which generates the user profile.
  5. INTERNATIONAL TRANSFERS
    FSA, as an international company, has international service providers that may render their services from outside the EU. As a result, it is possible that your data may be transferred outside of the European Union or the European Economic Area.
    In any event, FSA shall ensure that such data processing is protected by the appropriate safeguards, which may include, amongst others:

    • EU-Approved Standard Clauses. These are contractual clauses approved by the European supervisory authority that provide sufficient safeguards to ensure that data processing complies with the requirements established by the European Data Protection Regulation.
    • Third-party certifications. These are framework agreements between various public authorities that establish a standardized framework for data processing pursuant to EU General Data Protection Regulation requirements.
  6. DURATION OF PROCESSING
    All data that you provide to us shall be processed as long as you do not unsubscribe to the newsletter or until FSA may deem that you are no longer interested in receiving messages from it.
    Once the term stated in this section has come to an end, FSA shall keep your personal data on record duly masked for statistical purposes or market surveys, provided this is possible, or duly locked in order to comply with any legal obligations to which the company is subject.
  7. EXERCISE OF YOUR RIGHTS
    You may at any time withdraw your consent to your data being processed for any of the above purposes.
    You make likewise exercise your rights of data access, rectification, erasure, objection, restriction or portability by writing a letter addressed to Avda Francesc Macià 60, pl. 20, 08208 Sabadell (Barcelona) Spain, with the subject line “Datos Personales”, or by sending an email to dataprivacy@fluidra.com.
    Should you have any inquiries or claims about how we process your personal data, or any other questions related to this matter, you may contact our Data Protection Officer at Avda. Francesc Macià 60, pl. 20, 08208 Sabadell (Barcelona), with the subject line or addressed for the attention of “Delegado de Protección de Datos”, or by writing an email to dataprivacy@fluidra.com. Should you not receive a reply within a reasonable amount of time, namely, you may lodge a claim with the Spanish Data Protection Agency.
